Sir,

We as Barotse National Youth League would like to respond to your statement that appeared in the FRIDAY POST NEWSPAPER dated 11th May 2012 on page 4 which was entitled SUSPENSION OF JUDGES IS A SERIOUS ISSUE-MWABA under the above HEADLINE you were quoted as having said the following;” If the President has not responded to the issue of Barotseland, why should some sections of Barotseland start reacting?

 

Zambia should remain one state, it is naïve for anyone to want to separate Zambia… we want to caution the foreign dignitaries that Zambia is not fighting for independence and they should leave the issue of Barotseland to be resolved internally”.

In fact we the people of Barotseland are fighting for independence because we are being colonized by you Northern Rhodesians actually this is the worst kind of colonization the world has ever witnessed because it is a black –to- black colonization.

For your own information Barotseland has never gotten independence but what the British did in 1964 was to transfer or shift  responsibilities with regard to protective arrangements from the British crown to the Zambian government, therefore, only you Northern Rhodesians got independence. In short we just helped you Northern Rhodesians to gain independence.
Therefore, this is the right time for Barotseland to gain its independence and our boundaries shall be determined as soon as we gain independence as per resolution No. AHG/16/1 of July 1964 that was resolved by the Head of States and Governments of the Organization of African Unity (OAU) which stipulated that “Any Country that attains independence must state the extent of its boundaries which must be supported by documentary proof.”

The resolution of the summit was concluded as follows; “The member states pledged themselves to respect the borders existing on their achievement or attainment of national independence”.

You are right when you say that Zambia is not fighting for independence but, Barotseland which is the other party that makes up Zambia is fighting for independence because of the crookedness of you Northern Rhodesians such that you failed to observe the conditions that brought together Northern Rhodesia and Barotseland to form the unitary State of Zambia

Mr. Mwaba first and foremost we wonder whether you understand and know what made Zambia to be one state? And we also wonder whether you have read your constitution (Zambian Constitution) Article 1. (1) Which states as follows; “Zambia is a unitary, indivisible multi-party and democratic sovereign state.”

Do you really know and understand Sir, what a UNITARY STATE IS? Because from your statement we realize that you are ignorant of what a unitary state is.

We therefore, urge you to go back to school especially the elementary education, and learn words, put special emphasis to the word unitary

We also politely and humbly request you to stop attacking foreign dignitaries, because they have done nothing wrong by meeting delegates from Barotseland. Instead blame you yourselves (Zambians) especially you Bembas and your David Kenneth Kaunda for being evil, wicked, treacherous, deceptive and cruel for unilaterally and arbitrarily abrogating the Barotseland Agreement 1964 with impunity and without shame.

It’s like you do not know that the very Agreement you Northern Rhodesians abrogated with impunity and without shame is the one that made you what you are today. We want to remind and inform you that the very Agreement you abrogated is the one that brought Northern Rhodesia and Barotseland to form the country called Zambia, which is now no more, because we the people of Barotseland have reverted to our earlier status before 24th October 1964, In accordance with the Vienna Convention Articles 60 and 70 respectively, because you the Northern Rhodesians did not observe the conditions that brought Barotseland and Northern Rhodesia together to form the unitary state of Zambia.

Therefore, we urge you not to comment on issues you do not know and understand, because Barotseland came into existence as early as the 14th century during that period Northern Rhodesia was not yet born. Moreover, your country did not have a name but was named after Cecil Rhodes.

Sir, you better concentrate on renaming your Country, recomposing your National anthem, redesigning your coat of arms and national flag, instead of wasting your energy on talking about Barotseland which is a separate nation or state from Zambia. By the way you shall not continue using the current coat of arms, National Anthem, name of the country Zambia and National flag because all of them represent two countries of Barotseland and Northern Rhodesia that nearly came together on 24thOctober 1964 to form the unitary state of Zambia, because the Barotseland Agreement 1964 has never tasted implementation.

Therefore, you better start finding your own name, coat of arms, national flag as well as National Anthem. But as for us the Barotse people everything remains the way they have been from time immemorial and we shall continue to call our country Barotseland, use our own flag, coat of arms and the National Anthem.

For your own information, Barotseland issue is not an internal matter but, it is an International one, because, Barotseland Agreement is an honorable international treaty. Moreover, we have been recognized by the International Community world over as a state or Nation that is different from Zambia and we are just waiting for repatriation and reparation processes which will be done under the auspices of the UNITED NATIONS very soon.

It must be noted by you Northern Rhodesians that we do not depend on you or your President in order to get what belongs to us. That is purely wishful thinking.

Finally we would like to educate you that this so called unitary state clause in your constitution (Zambian constitution) was only put in the constitution in 1996 but from 1964 to 1995 that clause was not there, we knew very well that it was targeting Barotseland.

Finally there is the general principle of law which states that “law cannot be applied retrospectively”
