Your Excellency,

We praise the almighty God that you are still alive to date. 

Your Excellency we implore and remind you the realities as follows:

In 1969 you and your government unilaterally abrogated the Barotseland Agreement 1964 with impunity and without shame thinking that when things shall backfire you could have died, but alas God is the God of mercy and justice.

 

Your Excellency you forgot that you made assurances to His Majesty the Litunga and the people of Barotseland that you shall honor the Barotseland Agreement, because it is an honorable international Agreement, but unfortunately for you, you did not honor the agreement because that’s what dishonest people like you do, because they are used to gain a living through deceit and dishonest.

Your Excellency soon after your government abrogated the Barotseland agreement in, January, 1972 you issued instructions to the police force to arrest the following Barotse Nationals for protesting against the unilateral abrogation of the Barotseland Agreement 1964; Mr. Welesani Mulele, Mr. Sitamulaho Sitamulaho, Mr. Pumulo Mulopo, Mr. Masialeti Wamunyima Mupatu, Mr. Kaunda Kuwabo, Mr. Lisulo Muchanza, Mr. Zeko Mulundumina and Mr. Mukena Kaluwe.

They all found themselves in maximum prison, because they opposed the move to abrogate the Barotseland Agreement 1964. Out of the above people you yourself arrested, only Mr. Mukena Kaluwe is still alive, shame on you and their blood shall be on your head and shall continue to haunt you throughout your life.

It pains us as youths to learn and know that after, you abrogated the Barotseland Agreement 1964, and deep down your inner self, you knew very well that you were the one who wronged the Barotse people, instead of apologizing and honoring the agreement, you went further to arrest and torture the same people you had wronged and you passed a verdict in favor of yourself. That was very wrong because there is an international principle which states that “no one can be a judge in his own cause”

Your Excellency we wonder why you were a player and referee at the same time, because you and the people of Barotseland had a locus standi in the Barotseland Agreement 1964, which is now null and void. Because in 1993 in a letter written by Brig. General Godfrey Miyanda who, was by then, Minister without portfolio in the second republic, which was addressed to the Ngambela of Barotseland reaffirmed that you abrogated the Barotseland Agreement and it became stale and dead because you, Mr. K.D. Kaunda made their work easier for them because it was no longer in force. This letter was written just after three (3) years you had left the presidency.

This goes further to show how hateful you and your government had been towards the people of Barotseland. We the people of Barotseland meant well when we agreed to merge with you the Northern Rhodesians not knowing that we were signing an agreement with “wolves “headed by you.                                      

And you forgot that had it not been for Barotseland you could have not been where you are today, because you literally   had nothing and you were wallowing in abject poverty.

Your Excellency we as Barotse youths are very much alive to the fact that many of our people have been arrested and tortured over the issue of Barotseland Agreement 1964 by Zambian successive governments including your government, in fact it was worse during your regime.

Your Excellency during your tenure of office your government enacted very retrogressive and draconian laws that were enforced in order to abrogate the Barotseland Agreement 1964.

Your Excellency we have to inform you without reservation that posterity has judged you harshly, because you thought that you would die before the issue of Barotseland Agreement backfired on you sir and it will torment you even in death.

For your own information we the people of Barotseland have reverted  to our earlier status before 1964 October, 24, in accordance with the Vienna convention Articles 60 and 70 respectively which provide as follows:
ARTICLE 60
“Termination or suspension of operation of the treaty as a consequence of its breach:

a.    A material breach of a bilateral treaty by one of the parties entitles the other to invoke the breach as a ground for terminating the treaty or suspending its operation in whole or in part;

b.    A material breach of a bilateral treaty, for the purpose of this Article; consists;
(b)   Violation of a provision essential to the accomplishment of the object or purpose of the treaty”

ARTICLE 70
“Consequences of termination of a treaty
Unless the treaty, otherwise, provides or the parties agree, the termination of a treaty under its provisions or in accordance with the present convention;

(a)    Releases the parties from any obligation to further, perform the treaty”.

Your Excellency in your speech dated 11th August 1969 which you addressed to the United National Independence Party (UNIP) cadres at Matero Hall, Lusaka, Zambia, which was entitled “TOWARDS COMPLETE INDEPENDENCE” you had this to say with regard to the Litunga’s mineral rights, you said the following and you cannot deny that your Excellency because it is on record:
 
“I shall now deal with the other types of mineral Rights. Litunga’s Rights. The Litunga holds rights to determine conditions of prospecting licenses, mining leases, etc. and, to claim royalty on minerals in certain areas. I am afraid I have to terminate these rights completely and without compensation.

The rights of Litunga should not be different to those of other traditional rulers. The rights of Litunga are not different of the nation, and I and my government are the elected custodians of the interests of the nation.

The Litunga can be rest assured, however, that we shall exercise these rights in the best interests of the nation as a whole”.

Your Excellency, honestly speaking were you telling the truth when you said that the Litunga is like any other “chief”?  We wonder which chief could be equated to the Litunga, because even in your myopic thinking, you must have been embarrassed when you collected a coterie of people in February 1962 comprising of paramount chiefs Chitimukulu of the Bemba of Kasama and Undi of the Chewa people of Katete, Senior chief Mwamba of the Bemba people of Mpika and Chief Mapanza of the Tonga people of Choma, whom you paraded before Mr. Ian McLeod, the Secretary of State for the colonies , claiming that they were chiefs representing  people supporting the efforts to secure Independence.

In reply the Secretary of State had rebuffed you that the only personality who was recognized by the British Crown was the successor to His Majesty King Lewanika with whom treaties were signed.

It was from that episode that, you went to His Majesty the Litunga Sir Mwanawina   Lewanika III K.B.E to plead with him for support and in the process you had openly wept (crocodile tears) which resulted in the coining and insertion of the words;
“ONE LAND AND ONE NATION IS OUR CRY” in the third stanza of the Zambian National Anthem.

Your Excellency we inform and remind you without reservation that the Litunga is greater than yourself and your successors including those Chiefs you paraded in 1962 whose successors are still on thrones to date.

In addition to that, Your Excellency, it was a pity and shameful for a person of your status at that time to illegally and arbitrarily took away the Litunga’s mineral rights with impunity just a few years after the Barotseland Agreement was signed of which you were a signatory (remember   that you capitalized on the ignorance of the Northern Rhodesians and Barotzis, you were neither a Northern Rhodesian nor a Barotse National, but you were a Munyasaland).

You see Your Excellency; there is an adage which says “WHAT GOES AROUND COMES AROUND”

And also the Bible says in the book of Galatians chapter 6 verse 7 “Man cannot mock God, but he shall reap what he sows”.

Your Excellency, you and your government thought you were very clever, when you unilaterally abrogated the Barotseland Agreement 1964, but alas the very Agreement you abrogated has caught up with you today.

Most of us youths were not born, when you signed and abrogated the Barotseland Agreement 1964, but yet, by the grace of God we managed to research on the matter until we discovered the truth about the agreement.

Your Excellency, from abrogating the agreement, you went further to hide it and kept the people of Barotseland in total darkness concerning the very agreement that made you and your friends from Northern Rhodesia who you are today.

Therefore, your Excellency, since you have been dishonest, deceitful, crooked, and treacherous to the people of Barotseland, we humbly and politely demand that you publicly apologize to the people of Barotseland, Britain and the world at large without reservation, for unilaterally abrogating an honorable International treaty, failure to do so we as Barotse youths will have no choice, but shall petition the International community and all the organizations that honored you to publicly dishonor you, because you do not deserve to be honored. Moreover, we did it deliberately not to address you as a Doctor because that is an honorary Doctorate and for us as youths from Barotseland you do not deserve it.

Your Excellency with due respect it is a pity and shameful for a person of your status and age to claim that you are the one who initiated the slogan “ONE ZAMBIA ONE NATION” when deep down in your inner self, you know that you are not telling the truth.

We would like to remind and inform you that the slogan ONE ZAMBIA ONE NATION was not brought or initiated by yourself Sir, but was brought by the very Agreement you unilaterally and arbitrarily abrogated with impunity.

In order to substantiate our argument, may we draw your attention to the Barotseland Agreement 1964 paragraph three (3) of the preamble which states that;

“Whereas it is the wish of the government of Northern Rhodesia and of the Litunga of Barotseland, his council and the chiefs and the people of Barotseland that Northern Rhodesia should proceed to independence as  ONE COUNTRY AND THAT ALL ITS PEOPLES SHOULD BE ONE NATION:

Your Excellency we challenge you to deny the above statement fact

Your Excellency because of your misdeeds all your successors followed suit in your steps, to substantiate our case you yourself, Your Excellency, you were quoted in one of the Daily News papers that “I AM HAPPY THAT ONE OF MY BOYS IS PRESIDENT

This was in reference to the current president of the Republic of Zambia His Excellency Mr. Michael Chilufya Sata.

This confirms that he and other Presidents who were there before him have been under your tutorage, its no wonder before the Barotse National Council meeting 2012 many soldiers and police officers trooped into Barotseland in order to intimidate people, this has been your  style of dealing with the people of Barotseland.

We wonder whether the police and Army officers were part or signatory to the Barotseland Agreement 1964, if they were not why successive Zambian governments including yours have been using the police and Army to intimidate, arrest, torture, maim and kill people of Barotseland because of their displeasure over the abrogation of the Barotseland Agreement1964 which brought Zambia into existence?

It is no wonder Prophet T.B. Joshua once said in one of his sermons that “FALSE PEOPLE ALWAYS USE INTIMIDATION AND PROPAGANDA BECAUSE THEY HAVE NO TRUTH IN THEM” we agree with him 100% that’s exactly what you and your successors have been doing because there is no truth in you and you have never spoken the truth as far as the issue of Barotseland Agreement is concerned.

All that you could do was to enact and enforce jungle and draconian laws to persecute the people of Barotseland who have been consistent in telling the truth over the abrogation of Barotseland agreement 1964.

Your government and those of your successors have been arresting and charging Barotse Nationals with frivolous and vexatious treason as well as secession charges.

Your Excellency you never governed Zambia using the rule of law which is one of the fundamental principles of human rights and good governance world over, and its no wonder you never did that because by nature, you are a Dictator, that’s the reason why you ruled using an iron fist.

We therefore, politely, and humbly  urge you to advise Mr. Michael Chilufya Sata to remove the paramilitary police and Army personnel who are stationed in Barotseland because that’s a sheer waste of your country Zambia‘s resources and there is no one fighting in Barotseland.

In addition, to that Barotseland is a different and separate country from Zambia and Mr. Sata should  stop thinking that he has control over Barotseland, if he still thinks in those lines too bad for him, because that’s a wishful thinking and we feel sorry for you and him that, both of you are still living in the past.                                                                                                                                            

This is a timely advice because very soon repatriation and reparation processes shall begin that’s when you Zambians shall feel the pinch of sharing resources and you shall remember the resources you are now spending in the up keep of those police and Army Officers the government has deployed in Barotseland, because we the people of Barotseland have reverted to our earlier or original status before the Barotseland Agreement was signed and we shall never swallow our words.

We politely and humbly urge and advise the Zambian government to accept the reality that Barotseland is no longer part of Zambia.  You know too well deep down your heart that you are the one who brought this mess to the Zambian people you and your colleagues or comrades in Zambia have no choice, but to swallow the bitter pill of separating with Barotseland, which is the land of honey and milk enough is enough we have been tortured, insulted, killed, arrested, harassed, teased and maliciously prosecuted by Zambians for the past forty-seven (47) years.

Finally, your Excellency, we would like to urge you and your fellow Zambians to go back to school and learn words and their meanings. Put special emphasis to the word UNITARY because we realize that many of you do not know its meaning despite you putting it in your constitution.

Now may we draw your attention to the very constitution of yours (Zambian Constitution) in Article 1. (1), which states as follows:”Zambia is a Unitary, indivisible, multi-party and democratic sovereign state”

This goes further to show the ignorance of you Zambians such that you fail to grasp and understand simple words like Unitary, that is why you say it is Indivisible because you do not know its meaning.

Your Excellency without wasting much time, we want to educate you that a Unitary state is Divisible or breakable because it is the coming together of two (2) or more states or nations, this is the state of Zambia which is the coming together of Barotseland and Northern Rhodesia in 1964. The Unitary state is similar to a federal state and they can disintegrate when the conditions that brought them together  are not observed

It is different from a Monolithic State which is indivisible or unbreakable in nature; examples of Monolithic states are Zimbabwe, France, Haiti, Uruguay, Iran and Mexico

Therefore, it is wrong for you Zambians to insert the word Indivisible when are talking about or of a Unitary State.

Therefore, we humbly urge you and your colleagues from Zambia not to behave like the Camel Character in the story of an Arab and his camel in the desert on a cold night.
